LEGAL BASIS FOR A DIGITAL CITIZEN ID

Abstract
Background. Digital technologies penetrating into all spheres of public and personal life lead to the transformation of many legal institutions. Login to cyberspace is predetermined by using special authenticators (login, nickname, avatar, digital code, etc.). In this case, the digital authenticator may not coincide with the personal data recorded in the identity document of the citizen. The presence of systemic gaps in legal regulation of digital IDs determines the relevance of research. The main goal is to analyze the legal regime of a digital citizen ID. The goal implies solving the following tasks: systematizing the elements of digitalization provided for by the national project “Digital Economy”; highlighting the legal features of digital personal identification; considering the main problems arising due to the difference between digital identification and civil registration. Materials and methods. The empirical basis of research is made up by policy documents that define the digital development strategy of the Russian Federation. Particular attention is paid to Decree of the President of the Russian Federation dated May 7, 2024 No. 309 “On the national development goals of the Russian Federation through 2030 and for the future until 2036”. Results. The article indicates that the key elements of the concept of providing state and municipal services in the new context are the digital profile and the minimization of physical documents (introduction of a single citizen ID in digital form). Conclusions. Distinction should be made between an electronic signature of documents and an electronic identity document. If the first element has its legal basis, then in relation to the second element, the Ministry of Digital Development of the Russian Federation issued an official statement on freezing the project due to the sanctions pressure.
